Terms of Use

ElySpace IT Services LLP ("ElySpace") provides global web hosting solutions. We are committed to safeguarding each client and delivering top-tier service. The following guidelines help us achieve this goal. Please read them thoroughly before placing an order or using our services.

Content Guidelines

All services provided by ElySpace must be used for lawful purposes only. Storing, transmitting, or presenting unlawful material is strictly prohibited. This includes copyrighted content, obscene or threatening material, and anything protected by trade secrets or relevant laws. By using our services, you agree to indemnify ElySpace against claims arising from your use of our services that cause harm to you or others.

Pornography and adult-related material are strictly forbidden on ElySpace servers. This includes sites implying sexual content or linking to such material. We also prohibit content promoting illegal activities or harmful to ElySpace servers or the internet. Linking to such content is banned. For inquiries, contact our sales department.

Examples of Unacceptable Content

  • Pirated software
  • Bulk email tools
  • Pornography
  • Hacking/cracking websites
  • Warez or copyrighted MP3s
  • Material violating Indian law
  • Sites containing or linking to harmful public health, safety, or welfare information (e.g., bomb-making instructions)

ElySpace reserves the sole authority to determine if content violates these policies and may deactivate or remove any site at any time for any reason.

Copyright Violations

ElySpace will respond to all properly formatted infringement notices in compliance with the Indian Copyright Act and other applicable copyright laws. Improperly formatted notices may not be processed. Reports of infringement will be handled as per Indian laws.

System Resource Usage

If ElySpace determines that an account is consuming excessive system resources, it may temporarily suspend the account. If necessary, we will issue a notice granting seven (7) days to upgrade to a VPS or another recommended plan—or migrate to a different provider. This measure applies in extreme cases, and we strive to collaborate with you before taking this step.

ElySpace retains the final authority to determine if an account violates this policy, evaluating each case individually.

Backups

ElySpace creates nightly backups for Shared, Reseller, and WordPress hosting accounts. However, these backups are primarily for administrative purposes and are not guaranteed. You are responsible for maintaining your own backups. ElySpace will not compensate for lost or incomplete data, even if caused by our error. While we aim to provide complete backups, their availability is not assured. Always maintain your own site backups.

Our primary backup solution relies on JetBackup, not the default cPanel backup system. You can create manual backups using JetBackup anytime. If you request our staff to generate a cPanel backup, a fee will apply—contact our Billing department for details.

You cannot use your hosting account for backups or storage unrelated to your website’s core functionality. ElySpace reserves the right to delete backups from your hosting account with or without prior notice. We may also remove excessively large backups, temp files, or logs affecting server performance. Any cPanel backups stored on our servers are automatically deleted after fourteen (14) days.

Our backup system supports most filename characters (UTF-8), but certain special symbols can trigger errors across various storage platforms. Avoid them to prevent backup issues.

Some files and folders are excluded from backup due to compatibility issues. This list is not exhaustive and is intended to help you avoid backup errors.

Unsolicited Email (SPAM)

Sending SPAM—or unsolicited bulk emails—directly from an ElySpace server or using an ElySpace-based email address as a return address is strictly prohibited. Promoting any site hosted on ElySpace via SPAM also violates this policy. ElySpace alone determines violations, and offending sites will be taken down immediately.

In confirmed SPAM cases, we reserve the right to charge $90 per hour for cleanup and investigative tasks related to unlawful mailings.

Support Abuse

Our ElySpace staff treats every client with respect and courtesy. In return, we expect polite communication from you. If our staff observes disrespectful or demeaning behavior, your account may be suspended, and you may be asked to find an alternative hosting provider. Should we terminate your service for support abuse, you will have ten (10) days to seek another host.

ElySpace determines whether support abuse has occurred. We may deactivate accounts instantly if needed and report incidents to the appropriate authorities if necessary.

Cancellations

All cancellations are managed by our Billing department. A cancellation request must be submitted via your client area. Upon receipt, our Billing team will confirm and process it.

We require cancellations through the client area to verify your identity and ensure you understand that all files and emails will be removed once the cancellation is processed.

You must complete a cancellation form explaining your reasons and preferences. Two options are available:

1) Immediate Cancellation: Requests submitted before 9 AM (IST) are typically processed the same day at approximately 9 AM. Requests submitted after 9 AM are processed the following day at 9 AM.

2) End of Billing Period: Your service remains active until the current billing cycle ends, then cancels automatically on the due date.

Once submitted, our Billing team will cancel your service as selected and send confirmation.

Payments and Billing

We provide at least ten (10) days’ advance notice of renewal pricing for monthly, annual, or longer-term subscriptions. Unless otherwise stated, ElySpace will automatically bill your saved payment method:

- Seven (7) days before the due date,
- On the due date (if the initial attempt fails),
- Three (3) days after the due date (if the second attempt fails).

By continuing to use our service, you authorize ElySpace to bill your payment method for each renewal term unless canceled before the charge date. All fees are in Indian Rupees (INR) or, where applicable, U.S. Dollars converted into INR, and may change with proper notice.

ElySpace can only auto-charge cards on file. For other payment methods (e.g., PayPal one-time payments), you must pay manually by the due date. You are responsible for accurate billing details and adequate funds. ElySpace bears no liability for overdraft or banking charges. We also screen all orders for fraud; if your order does not pass, services may be withheld.

Price Changes

ElySpace reserves the right to update prices or other charges at any time. We will give you at least thirty (30) days’ notice before billing revised prices for annual or longer-term plans. It is your responsibility to monitor your Client Area for current pricing and any notices distributed via email or system notifications.

Late Payments

If you fail to pay by the end of your billing term, you have a one (1)-day grace period. If no payment is made within that day, ElySpace may suspend your services. We may terminate Shared, WordPress, and Reseller Hosting fourteen (10) days after the due date, and VPS Hosting three (2) days after the due date.

ElySpace assumes no responsibility for damages or data loss resulting from suspension or termination for non-payment. We may refuse to reactivate your service until unpaid invoices are settled.

Duplicate Payments

A “duplicate payment” occurs if you accidentally make more than one payment for a single service—often due to technical errors or oversight—using a credit/debit card or PayPal. A common example is when someone has a PayPal subscription active but also makes a manual payment.

Automatic Credit

If our system detects a duplicate payment, the extra amount is credited automatically to your ElySpace account unless or until you inform us otherwise.

Refund Options

If you discover a duplicate payment, you have two choices:

1) Full Refund as Account Credit: You may request a complete refund, which we will issue as a credit to your account. You can use this credit for future purchases or current services.

2) Partial Monetary Refund: You can opt for a partial refund. In such cases, ElySpace will deduct applicable gateway transaction fees, and the remainder is refunded to your original payment method.

Notification Period

You must inform ElySpace of any duplicate payments within fourteen (14) days from the payment date. If notified beyond the 14-day window, a monetary refund will not be provided, and the excess payment will remain as credit on your ElySpace account.

Money-Back Guarantee and Refund Policies

Duration and Scope of Guarantee:

- The 30-Day Money-Back Guarantee applies only to Shared Web Hosting, Reseller Hosting, WordPress Hosting, Email Hosting, Python Hosting, and Managed WordPress Hosting.
- The 3-Day Money-Back Guarantee applies only to VPS Hosting.
The clock starts on your account activation date, not the order date.

Exceptions to the Guarantee:

Our Money-Back Guarantee does not apply to:

- Add-on services: Dedicated IPs, SSL Certificates, SiteLock Website Security, SpamExperts Email Services, Margetgoo SEO Services, WHMCS License, LiteSpeed Web Server License, cPanel License, CloudLinux License, Imunify360 License, Cloud Remote Backup, MailChannels Outbound Email Filtering, Block Storage, Disk Space Add-ons, Turbo+ Boost Add-ons, Resources Boost Add-ons, Inodes Add-ons;
- Account funds;
- Domain reseller funds;
- Domain registration, transfer, or ID Protection services;
- Paid support or migration services;
- Bandwidth overages;
- Managed WordPress Hosting (Enterprise plans).
Renewals of any service type are not covered. If you breach these Terms or other agreements, your Money-Back Guarantee is forfeited.

General Refund Policies:
Once the Money-Back Guarantee period has passed, ElySpace does not issue refunds. Any account credits are non-refundable and valid for two (2) years after the final hosting account is terminated. Unused credits beyond this period will be voided without liability to ElySpace.

Only first-time accounts qualify for a refund. If you previously held an account, canceled, and rejoined, or opened a second account for similar services, you are ineligible for a refund. Violations of our agreements nullify refund rights.

Additional No-Refund Clause

Please note that there is no refund for web design services or WHMCS licenses. We also do not offer refunds for development or service-based work performed by us. Additionally, no refunds will be provided for downloadable files of any kind.

Introductory Offer Eligibility

Introductory Offers (“Introductory Offers”) encourage the creation of new websites. These offers are available to new customers opening a new account and existing customers initiating a distinct project (“New Website”).

These offers apply only to fresh projects. Existing customers cannot apply Introductory Offers to existing websites (“Existing Websites”), which continue under standard or renewal pricing.

To ensure fairness, you cannot transfer or re-register an Existing Website under a new account to benefit from an Introductory Offer. Accounts violating this may be suspended or terminated. Additionally, no refunds—whether standard or within the 7/30-day period—will be granted for infringing transactions.

Free Migration Policies

ElySpace’s Migrations Team can assist in transferring your website(s) to our servers. This service is complimentary but not guaranteed, and timing may vary. Different hosting providers manage data differently, and some older platforms may be incompatible for direct migration. Free migration services are available for 60 days from your sign-up date. Beyond that, charges may apply—contact our Support department for details. ElySpace is not responsible for lost or missing data during or after the transfer. You are fully responsible for maintaining your own backups.

Free Domain Name Policies

When you sign up for a 24 or 36-month hosting plan (Shared Hosting & WordPress Hosting), you are eligible for one free domain registration or transfer for the first year.

When you sign up for a 12, 24, or 36-month hosting plan (Reseller Hosting, VPS Hosting, Managed WordPress Hosting), you are also eligible for one free domain registration or transfer for the first year.

Domain Registration: Only certain domain extensions qualify for this offer. Refer to this link for the list. The free domain must be registered at sign-up and is valid only for new customers. Unless otherwise specified, it applies to the initial year; renewals follow standard pricing.

Domain Transfer: A free domain transfer is available for certain extensions listed at this link. You have thirty (30) days from plan activation to claim this transfer by contacting our Billing department. The domain’s expiration date extends by one year, and subsequent renewals will be billed at the standard rate.

If you cancel within the 7/30-Day Money-Back Guarantee timeframe, your refund will exclude the domain registration or transfer cost at the prevailing rate. For further queries, contact our Sales Department before ordering.

Prohibited Persons (Countries, Regions, Entities, and Individuals)

Certain individuals, entities, and countries are restricted from using our services according to Indian legal requirements and our internal policies. By using our services, you represent and warrant that you are not located in any blacklisted or restricted region as determined by ElySpace, nor are you subject to any sanction or ban under Indian laws.

Countries We Cannot Do Business With
Pakistan (.pk): Due to the ongoing Kashmir Conflict between India and Pakistan, we cannot do business with Pakistani clients. Hosting accounts with Pakistani contact addresses will not be approved. ElySpace IT Services LLP operates from Watergam in Jammu and Kashmir, India, and we wish to avoid political or religious disputes.

Note: Indian law does not explicitly ban e-commerce with any country. However, ElySpace enforces its own policies to protect our business and clients by limiting certain online services.

If your billing address is in Pakistan and you have already made a purchase, your account will be suspended, and no refund will be issued.

(Applies only to Indian customers.) Transactions Restriction on Pakistan
Due to the Kashmir Conflict, hosting customers in Jammu and Kashmir (and other Indian states) are not permitted to use Pakistani payment gateways on their websites.

Failure to Follow Policies

Failure to comply with these Terms of Service may result in your account being suspended or deactivated. All accounts or servers hosted on ElySpace’s network must adhere to these guidelines.

We reserve the right to remove accounts without prior warning. Our general approach is to issue a warning first and proceed to account deactivation for repeat offenses, but we are not obligated to provide notice.

ElySpace also reserves the right to remove any site deemed, at its sole discretion, to contain unacceptable or undesirable content.
