ElySpace IT Services LLP (hereafter “ElySpae”) provides web hosting services worldwide. We have a responsibility to protect each customer and ensure the highest level of service. The guidelines below help us offer you the best service. Please read them thoroughly before placing an order or using ElySpae’s services.
The ElySpae Service Agreement is a separate contract between ElySpae and all customers. Please confirm you agree with the points below, as well as our entire Service Agreement, before signing up for or using ElySpae’s services. For questions, contact our sales team.

The ElySpae Domain Reseller Agreement sets out the general terms and conditions for using your ElySpae Domain Reseller account to resell ElySpae’s products and services.
All services provided by ElySpae must be used for lawful purposes only. The storage, transmission, or presentation of information, data, or material that violates any law is strictly prohibited. This includes copyrighted material, obscene or threatening content, and anything protected by trade secrets or other relevant statutes. By using our services, you agree to indemnify and hold ElySpae harmless for any claims resulting from use of our services that cause damage to you or any other party.
Pornography and sexual or adult-related material are strictly forbidden on ElySpae servers. This includes sites implying sexual content or linking to adult content. We also prohibit content promoting illegal activities or that may be harmful to ElySpae servers or the internet at large. Linking to such content is also banned. If you have questions, contact our sales department.
Examples of Non-Acceptable Content
ElySpae has the sole authority to determine whether certain content violates these policies and can deactivate or remove any site at any time, for any reason.
ElySpae will respond to all properly formatted infringement notices in accordance with the Indian Copyright Act and any other applicable copyright regulations. Notices of infringement that are not properly formatted may not be processed. We will handle infringement reports as outlined by applicable Indian laws.
If ElySpae’s team finds that an account is using excessive system resources, we may temporarily suspend it. If necessary, we will issue a notice granting you seven (7) days to either upgrade to a VPS or another recommended plan—or move to a different provider. This measure applies in extreme circumstances. We do our best to work with you before arriving at this point.
ElySpae will make the final decision on whether your account violates this policy, evaluating each case individually.

ElySpae creates nightly backups of Shared, Reseller, and WordPress hosting accounts. However, these backups are primarily for our administrative purposes and are not guaranteed. You are responsible for maintaining your own backups. ElySpae will not compensate for lost or incomplete data, even if the malfunction is attributed to our error. We will do our best to produce complete backups but cannot promise their availability. Always keep your own site backups.
Our main backup solution relies on JetBackup, not the default cPanel backup system. You may create manual backups using JetBackup at any time. If you wish our staff to generate a cPanel backup for you, a fee will apply—please contact our Billing department for a quote.
You cannot use your hosting account for backup or storage unrelated to your website’s core functionality. ElySpae reserves the right to delete backups from your hosting account with or without prior notice. We may also remove excessively large backups, temp files, or logs that affect server performance. Any cPanel backups stored on our servers are automatically deleted after fourteen (14) days.
Our backup system supports most filename characters (UTF-8), but certain special symbols can trigger errors across various storage platforms. We recommend avoiding them to prevent backup issues.

Some files and folders are excluded from backup due to compatibility issues. This list is not exhaustive; it is intended to help you prevent backup errors.

Sending SPAM—or unsolicited bulk emails—directly from an ElySpae server or using an ElySpae-based email address as a return address is strictly forbidden. Promoting any site hosted on ElySpae via SPAM also violates this policy. ElySpae alone will determine if there is a violation, and we will immediately take down any site found to be sending SPAM.
In proven cases of SPAM, we reserve the right to charge $90 per hour to cover any cleanup and investigative tasks linked to these unlawful mailings.
Help us stop SPAM! Please contact our abuse department if you suspect any SPAM activities.
Our staff at ElySpae treats every customer with respect and courtesy. In return, we expect you to address our team politely as well. If our staff observes a pattern of disrespectful or demeaning communication, your account may be suspended, and you may be asked to find an alternative hosting provider. Should we terminate your service for support abuse, you will have ten (10) days to seek another host.
ElySpae alone determines whether support abuse has occurred. We may deactivate accounts instantly if needed. We will also report any abuse incidents, including customer details, to the appropriate authorities if necessary.
All cancellations are handled by our Billing department. A cancellation request must be submitted via your client area. Upon receiving the cancellation request, our Billing team will confirm and process it.
We require you to cancel through the client area for these reasons: (a) to confirm your identity, and (b) to ensure you understand that all files and emails will be removed from our servers once the cancellation is processed.
You must complete a cancellation form explaining why you wish to cancel and how you want to proceed. Two cancellation options are available:
1) Immediate Cancellation: If you submit your request before 9 AM (IST), service cancellation typically occurs on the same day at approximately 9 AM. Requests submitted after 9 AM are processed the following day at 9 AM.
2) End of Billing Period: Your service remains active until your current billing cycle ends, then automatically cancels on the due date.
Once the form is submitted, our Billing team will cancel your service as per the selected option and send you a confirmation.
We provide at least ten (10) days’ advance notice of renewal pricing for monthly, annual, or longer-term subscriptions. Unless otherwise stated, ElySpae will automatically bill your saved payment method:
- seven (7) days before the due date,
- on the due date (if the initial attempt fails),
- three (3) days after the due date (if the second attempt fails).
By continuing to use our service, you authorize ElySpae to bill your payment method for each renewal term unless canceled before the charge date. All fees are in Indian Rupees (INR) or, where applicable, in U.S. Dollars converted into INR, and may be subject to change with proper notice.
ElySpae can only auto-charge cards on file. For other payment methods (e.g., PayPal one-time payments), you must pay manually by the due date. You are responsible for ensuring your billing details are accurate and your payment method has adequate funds. ElySpae bears no liability for overdraft or other banking charges. We also screen all orders for fraud; if your order does not pass, services may be withheld.
ElySpae reserves the right to update prices or other charges at any time. We will give you at least thirty (30) days’ notice before billing any revised price for annual or longer-term plans. It is your responsibility to monitor your Client Area for current pricing and any notices that we distribute via email or system notifications.
If you fail to pay by the end of your billing term, you have a one (1) day grace period. If no payment is made within that day, ElySpae may suspend your services. We may terminate Shared, WordPress, and Reseller Hosting fourteen (10) days after the due date, and VPS Hosting three (2) days after the due date.
ElySpae assumes no responsibility for damages or data loss resulting from suspension or termination for non-payment. We may also refuse to reactivate your service until all unpaid invoices are settled.
A “duplicate payment” occurs if you accidentally make more than one payment for a single service—often due to technical errors or oversight—using a credit/debit card or PayPal. A common example is when someone has a PayPal subscription active but also makes a manual payment.
Automatic Credit
Should our system detect a duplicate payment, the extra amount is credited automatically to your ElySpae account unless or until you tell us otherwise.
Refund Options
If you discover a duplicate payment, you have two choices:
1) Full Refund as Account Credit: You may request a complete refund, which we will issue as a credit to your account. You can then use this credit toward future purchases or current services.
2) Partial Monetary Refund: You can opt for a partial refund. In such cases, ElySpae will deduct any applicable gateway transaction fees, and the remainder is refunded to your original payment method.
Notification Period
You must inform ElySpae of any duplicate payments within fourteen (14) days from the payment date. If we are notified beyond the 14-day window, a monetary refund will not be provided, and the excess payment will remain as credit on your ElySpae account.
Duration and Scope of Guarantee:
- The 30-Day Money-Back Guarantee applies only to Shared Web Hosting, Reseller Hosting, WordPress Hosting, Email Hosting, Python Hosting, and Managed WordPress Hosting.
- The 3-Day Money-Back Guarantee applies only to VPS Hosting.
The clock starts on your account activation date, not the order date.
Exceptions to the Guarantee:
Our Money-Back Guarantee does not apply to:
- Add-on services: Dedicated IPs, SSL Certificates, SiteLock Website Security, SpamExperts Email Services, Margetgoo SEO Services, WHMCS License, LiteSpeed Web Server License, cPanel License, CloudLinux License, Imunify360 License, Cloud Remote Backup, MailChannels Outbound Email Filtering, Block Storage, Disk Space Add-ons, Turbo+ Boost Add-ons, Resources Boost Add-ons, Inodes Add-ons;
- Account funds;
- Domain reseller funds;
- Domain registration, transfer, or ID Protection services;
- Paid support or migration services;
- Bandwidth overages;
- Managed WordPress Hosting (Enterprise plans).
Renewals of any service type are not covered. If you breach these Terms or other agreements, your Money-Back Guarantee is forfeited.
General Refund Policies:
Once the Money-Back Guarantee period has passed, ElySpae does not issue refunds. Any account credits are non-refundable and remain valid for two (2) years after the final hosting account is terminated. Credits that remain unused beyond this period will be voided without liability to ElySpae.
Only first-time accounts qualify for a refund. If you previously held an account, canceled, and rejoined, or if you open a second account for a similar service, you are not eligible for a refund. Violations of our agreements also nullify any refund rights.
Please note that there is no refund for web design services or WHMCS licenses. We also do not offer refunds for any development or service-based work you have hired us to perform. In addition, no refunds will be provided for downloadable files of any kind.
Introductory Offers (“Introductory Offers”) are set up to encourage the creation of brand-new websites. These offers are available to new customers opening a new account and to existing customers initiating a new, distinct project (“New Website”).
These offers apply only to fresh projects. Existing customers can’t apply Introductory Offers to existing websites (“Existing Websites”). Existing sites continue under standard or renewal pricing.
In the interest of fairness, you cannot transfer or re-register an Existing Website under a new account to benefit from an Introductory Offer. Any accounts found violating this may be suspended or terminated. Additionally, no refunds—whether standard or within the 7/30-day period—will be granted for these infringing transactions.
ElySpae’s Migrations Team can help you transfer your website(s) to our servers. This is offered as a courtesy, and we do not guarantee its availability or a specific timeframe. Various hosting providers manage data differently, and some older platforms may be incompatible for direct migration. The free migration service remains available for 60 days from your sign-up date. Beyond that, charges may apply—contact our Support department for a quote. ElySpae is not responsible for any lost or missing data during or after the transfer. You bear full responsibility for maintaining your own backups.
When you sign up for a 24 or 36-month hosting plan (Shared Hosting & WordPress Hosting), you are eligible for one free domain registration or transfer for the first year.
When you sign up for a 12, 24, or 36-month hosting plan (Reseller Hosting, VPS Hosting, Managed WordPress Hosting), you are also eligible for one free domain registration or transfer for the first year.
Domain Registration: Only certain domain extensions qualify for this offer. Please refer to this link for the list. The free domain must be registered at the time of sign-up and is valid only for new customers. Unless otherwise specified, it applies to the initial year; renewals follow our standard domain pricing.
Domain Transfer: A free domain transfer is available for certain extensions listed at this link. You have thirty (30) days from plan activation to claim this transfer by contacting our Billing department. The domain’s expiration date extends by one year, and subsequent renewals will be billed at the standard rate.
If you cancel within the 7/30-Day Money-Back Guarantee timeframe, your refund will exclude the domain registration or transfer cost at the prevailing rate. For any further queries, please contact our Sales Department before ordering.
Certain individuals, entities, and countries are restricted from using our services according to Indian legal requirements and our internal policies. By using our services, you represent and warrant that you are not located in any blacklisted or restricted region as determined by ElySpae, nor are you a subject of any sanction or ban under Indian laws.
Countries We Cannot Do Business With
Pakistan (.pk): Unfortunately, because of the ongoing Kashmir Conflict between India and Pakistan, we cannot do business with Pakistani clients. We will not approve hosting accounts if the contact address is in Pakistan. ElySpae IT Services LLP is a Kashmir-based company in India, operating from Watergam in Jammu and Kashmir, and we do not wish to be caught in political or religious disputes.
Please note: Indian law does not explicitly ban e-commerce with any country. However, ElySpae enforces its own policies to safeguard our business and our clients by limiting certain online services.
If your billing address is in Pakistan and you have already made a purchase, your account will be suspended, and no refund will be issued.
(Applies only to Indian customers.) Transactions Restriction on Pakistan
Due to the Kashmir Conflict between India and Pakistan, our hosting customers in Jammu and Kashmir (and other Indian states) are not permitted to use Pakistani payment gateways on their websites.
Failure to comply with these Terms of Service may result in your account being suspended or deactivated. Any accounts or servers hosted on ElySpae’s network must adhere to these guidelines.
We reserve the right to remove accounts without prior warning. Our general approach is to give a warning first and proceed to account deactivation for repeat offenses, but we are not obliged to provide notice.
ElySpae also reserves the right to remove any site it deems, at its sole discretion, to contain unacceptable or undesirable content.
