A French site asks a few things of its host that an international provider rarely spells out: an invoice in euros, a straight answer about where personal data ends up, a database that survives accented characters, and a host whose identity the publisher can print in the mentions légales. What to check before you host a French site outside France

Your supervisory authority is the CNIL

The GDPR lets you complain to the supervisory authority where you live, where you work, or where the alleged infringement happened. For a publisher in France that is the Commission nationale de l'informatique et des libertés. Our commercial agreements choose foreign governing law for contract disputes, and our data protection page states in plain words that nothing in them limits your data protection rights or your right to bring a claim where you live. Read that sentence yourself before you sign, on any host, because plenty of terms of service quietly say the opposite.

Transfers out of the EEA are a fact here, not a footnote

India has no adequacy decision from the European Commission, so a transfer to an Indian company is not the same legal exercise as moving data between Lyon and Frankfurt. Our data protection page sets out which countries are in scope and which safeguards we rely on. Ask us for the current version of those safeguards in a ticket, in writing, before you commit a client's personal data to any platform. If a supplier cannot produce that on request, you have learned something useful for free.

Who is controller and who is processor

ElySpace is the processor for what you put on the platform: site files, databases, mailboxes, uploads and their backups. ElySpace is the controller for your own account, billing and support records. Towards your visitors and your customers, you remain the controller. That matters in France because it puts the cookie consent, the retention periods, the privacy notice and the register of processing on your side of the line, not ours. Knowing which side a task falls on is most of the work of a first audit.

ElySpace answers GDPR rights requests within one month of receiving them, with up to two further months for complex or repeated requests and notice inside the first month if that happens. There is also a grievance route that is acknowledged within 24 hours and aimed at closure within 15 days. When your DPO wants an export of hosted content rather than a formal request, the backup and export tools inside cPanel hand you most of it immediately, which is usually faster than any ticket queue.

Ask, then order

Open a ticket and ask for the current transfer safeguards, the data processing documentation your DPO will want, and the TVA treatment that will appear on your invoice. Read the euro figure and the renewal term in the store. Order when all four answers suit you.

Set the billing profile

Enter the company name, the registered address and your numéro de TVA intracommunautaire before the first invoice is raised. Correcting a VAT identifier once an invoice exists is far slower than typing it in once, and your accountant will ask for it in January regardless.

You keep your registrar and your domain stays exactly where it is. Lower the TTL a day ahead, check the copy on a temporary address, then repoint the records when you are satisfied. Your .fr registration is untouched by the move.

Most international hosts answer the data residency question with a world map and an adjective. Here is the version you can act on. Hosting a French site: FAQ

ElySpace prices its services in euros as well as US dollars and Indian rupees, and Euro is one of the six currencies in the selector at the top of the site. There is no figure printed here on purpose. Prices and renewal terms change, a stale number on a marketing page is worse than no number at all, and the only amount that binds either of us is the one shown at checkout in the ElySpace store. Set your currency there, read the first term and the renewal term, then decide.

The GDPR gives you the right to complain to the supervisory authority where you live, where you work, or where the alleged infringement took place. For a publisher or a visitor in France that is the Commission nationale de l'informatique et des libertés. Our data protection notice confirms that nothing in the ElySpace agreements, including the clauses choosing foreign governing law, limits that right or your right to bring a claim where you live. You can also use our internal grievance route first if you prefer to try that.

India does not have a European Commission adequacy decision, so those transfers rest on contractual safeguards rather than on adequacy. The transfers section of our data protection notice explains the mechanism, and you can ask us in a ticket for the current safeguards and the countries in scope. Get that answer in writing before you host client data, here or anywhere.

Yes, and you do not have to move the domain to do it. Hosting and registration are separate services. Leave the .fr where it is registered, point its nameservers or its A and MX records at your ElySpace account, and the site and mail serve normally. Registration is the separate question: .fr is operated by AFNIC and is not currently listed in the ElySpace domain extension catalogue, so if you want us to register or transfer the domain itself, ask us before you plan on it.

AFNIC restricts .fr to registrants with a presence in the European Union, extended to Iceland, Liechtenstein, Norway and Switzerland. In practice that means an individual resident in one of those territories, or a legal entity with its registered office or an establishment there. AFNIC can verify registrant details and can suspend or delete a domain whose details are wrong, incomplete or unreachable, so keep the registrant record accurate and the contact address monitored. A company based outside that area normally needs an EU entity or a local presence arrangement to hold the name.

Ask for it in a ticket and ask before you order, not after. Our published position is that ElySpace is the processor for the site files, databases, mailboxes and backups you place on the platform, and the controller for your account, billing and support records. That split is the starting point your DPO will work from. Request the current written processing documentation and the transfer safeguards together, since a French client audit will normally ask for both in the same breath.

Tax treatment on a cross-border supply of electronic services depends on whether you are buying as a business or as a consumer and on the identifiers recorded against your account, which is why the figure that matters ends up on your invoice rather than on a marketing page. Correcting an identifier once an invoice exists means a reissue.

If you send transactional mail to French consumer mailboxes, publish SPF, DKIM and DMARC records on your own domain, because unauthenticated mail is the usual reason a confirmation email never arrives. Several of them land on pages you host. French law requires published mentions légales that identify the publisher and the host, conditions générales de vente a customer can read and keep before ordering, a 14-day right of withdrawal for consumer sales at distance, and a named consumer mediator. Hosting matters because those pages have to stay reachable and provable: keep them as real indexed pages, keep restorable backups, and keep order records you could produce if the DGCCRF asked. The CNIL's published position is that refusing trackers must be as simple as accepting them, that non-essential trackers must not be set before consent is given, and that you must be able to demonstrate the consent you rely on. Audience measurement can be exempt from consent only where it is configured to the conditions the CNIL sets out. This is the site publisher's duty rather than the host's, but the tags run on the site you host, so audit them before launch and again after any tag manager change.
